Sendlume is a technology platform designed to assist professionals and businesses in automating and personalizing cold email outreach. Our features include, but are not limited to:

• Cold Email Campaigns: Tools to create, schedule, and send cold emails to your prospects in a scalable and compliant manner.
• AI-Powered Email Writing: Advanced artificial intelligence that personalizes email content based on user inputs and contextual data from integrations.
• Third-Party Integrations: Seamless connectivity with platforms such as Notion and others to enrich email personalization by accessing contextual user data with consent.
• Analytics Dashboard: Comprehensive metrics and reporting to track campaign performance, engagement, and outcomes.
• Account Management: User profile setups, credential management, and security features to maintain account integrity.
• Data Import: Ability to upload CSV files or other data formats for managing contacts and campaign targets.
• Continuous Feature Updates: Regular enhancements and potential addition of new functionalities reflecting user feedback and technological advances.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at our discretion. Any such changes will not absolve you from your obligations under these Terms.

3. Eligibility

To use Sendlume, you must meet the following criteria:

• Age Requirement: You confirm that you are at least 18 years old. If you are under 18, you may not register or use our Service.
• Professional and Business Use: Sendlume is intended solely for professional and commercial purposes, helping users conduct targeted outreach aligned with industry standards. The platform is not designed for personal or consumer use outside these contexts.
• Global Availability: Sendlume is accessible worldwide without geographic restrictions. Users from any country may register and use the Service, subject to compliance with local laws.
• Integration Consent: When connecting third-party integrations, you must authorize both Sendlume and the third-party platform to exchange and process data necessary for service delivery and AI personalization.

By using Sendlume, you affirm that you meet these eligibility requirements and acknowledge your responsibility to ensure compliance.

4. Account Registration

Creating and maintaining an account entails:

• Accurate Information: You agree to provide truthful, current, and complete information during registration and update it as necessary to keep it accurate.
• Account Security: Protect your username, password, and access credentials. You are solely responsible for all activities performed through your account.
• Unauthorized Access: If you suspect unauthorized use or breach of account security, you must notify us immediately at support@sendlume.com.
• Account Non-transferability: Accounts are personal and may not be transferred, sold, or shared without prior permission from Sendlume.

Failure to observe these conditions may result in account suspension or termination.

5. Fees, Payment, Trial, and Refunds

Sendlume offers various subscription options:

• Freemium Model: Users may access a 7-day free trial featuring essential functionalities designed to evaluate the platform before purchasing.
• Subscription Plans: Post-trial, users must select a paid monthly subscription plan to continue premium access.
• Automatic Renewal: Subscriptions renew automatically each month at the prevailing rate until canceled through the user account portal.
• Payment Responsibility: You are responsible for timely payments of any subscription fees and agree to provide accurate billing information.
• Refund Policy: Refunds may be requested within 48 hours of the first payment. After this period, all payments are non-refundable.
• Payment Failures: Late or failed payments may result in suspension or termination of service until resolution.

We reserve the right to change pricing and terms of subscription plans with reasonable notice.

6. User Conduct and Content Restrictions

Users must ensure that their use of Sendlume adheres to ethical and legal standards. Prohibited actions include, but are not limited to:

• Unsolicited Communications: Sending spam or unsolicited emails that violate laws or industry best practice.
• Illegal or Harmful Content: Uploading, transmitting, or distributing content that is offensive, abusive, defamatory, discriminatory, infringing on others' rights, or that violates any applicable law.
• Integration Abuse: Exploiting integrations for unauthorized data extraction, automated scraping, or breaching third-party terms of service.
• Platform Security: Attempting to disrupt, hack, or compromise the Service, including circumventing restrictions or limits imposed.
• Privacy Violations: Collecting, storing, or using personal data about others without proper authorization or compliance.

We reserve the right to investigate reports of misconduct and may suspend or terminate accounts involved in violations without prior notice. Users acknowledge that such action may be necessary to protect the Service integrity and community wellbeing.

7. Intellectual Property Rights

• Ownership: All intellectual property rights in the Service, software, content, and documentation are owned by Sendlume or its licensors.
• User Content: You retain ownership of your uploaded data and generated content. By using Sendlume, you grant us a limited license to use, process, and store your content solely for delivering and improving the Service.
• Restrictions: Users may not copy, modify, rent, lease, loan, sell, distribute, or create derivative works based on the Service except as expressly authorized.

8. Privacy and Data Protection

Your privacy is important to us. Use of the Service is governed by our Privacy Policy, which explains data collection, use, and protection measures. You agree to comply with all applicable data protection laws relating to your use of the platform, including obtaining necessary consents for communications and data processing.

9. Suspension, Termination, and Account Deletion

• Termination by Sendlume: We reserve the right to suspend or terminate your account at any time for violations of these Terms or other policies, or where legally required.
• User-Initiated Termination: Users may cancel their subscriptions and delete accounts at any time through the Service interface or by contacting support.
• Data Deletion: Following account termination, your data will be retained for 60 days to allow recovery in case of reconsideration, after which all personal data will be permanently deleted.
• Effect of Termination: Termination does not relieve you of obligations or liabilities accrued prior to termination.

10. Disclaimers and Limitation of Liability

• “As Is” Service: The Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
• No Guarantee: We do not guarantee uninterrupted service, error-free operation, or specific outcomes from use of the platform.
• Limitation: Sendlume shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, even if advised of the possibility of such damages.
• Liability Cap: Our total liability under these Terms shall not exceed the amount you paid to us in the six months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sendlume and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your violation of these Terms or misuse of the Service.

12. Changes to Terms

We may update or modify these Terms at any time. Notice of material changes will be provided through email or platform notifications. Continued use of the Service after changes signifies your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

• These Terms are governed by the laws of India.
• Any disputes arising under or related to these Terms shall be resolved by amicable negotiation or binding arbitration as applicable.
• Users agree to submit to the personal jurisdiction of courts located in India for matters not subject to arbitration.

14. Miscellaneous

• Severability: If any provision is found unenforceable, the remainder will stay in effect.
• Entire Agreement: These Terms, along with the Privacy Policy and other referenced policies, constitute the entire agreement between you and Sendlume.
• No Waiver: Failure to enforce any provision does not constitute a waiver of rights.
